Mason County Probate Jurisdiction

Kentucky does not use a separate probate court for Mason County. The Kentucky District Court handles probate of wills, and KRS 24A.120 gives District Court exclusive jurisdiction over probate matters except contested adversary proceedings. When an estate dispute becomes an adversary matter, the case belongs in Circuit Court. That split is important because a routine estate filing and a contested estate lawsuit may not follow the same case path.

For Mason County, routine probate filings begin with Mason District Court through the Office of Circuit Court Clerk at the Mason County Justice Center. If the dispute is contested, Circuit Court involvement may be needed through the same Office of Circuit Court Clerk, with the Circuit Court phone number 606-564-4340.

The same building can hold more than one record path. A probate case may be opened on the District Court side, but a related recorded will or affidavit of descent may be a County Clerk legal record. A contested estate dispute may move to Circuit Court. Asking which office holds the exact record prevents a common Mason County search error.

Probate Terms Defined

Probate files use terms that do not appear in ordinary civil records. These definitions help separate the person who died, the person who handles the estate, and the type of court appointment being requested.

Testator

A person who made a will.

Executor

The person named to carry out a will after appointment by the court.

Intestate

A death without a valid will, which means estate distribution follows Kentucky law.

Guardianship

A court appointment to handle personal care or legal decisions for someone who needs protection.

Conservatorship

A court appointment focused on managing property or financial affairs.

Search Mason County Estate Records

A recorded will, renunciation, disclaimer, deed from an estate, affidavit of descent, or similar legal instrument may be searched through the Mason County Clerk legal-records page. The County Clerk says courthouse records are mostly from 1795 to the present, indexes are mostly back to 1795, and online images are mostly January 2004 to current. Online access uses eCCLIX, while in-office viewing of public county-clerk records is free.

The county clerk's long index range is valuable for older estate research, but the online image range is narrower. A person looking for a 19th-century recorded will may find that the index exists while the image must be reviewed in office or requested from the clerk. A person looking for a recent estate case should start with the court clerk instead.

File Mason County Probate

The research did not locate a Mason-specific probate packet or estate checklist. Use the District Court and Circuit Court Clerk contacts to confirm local form, bond, fiduciary, inventory, creditor notice, settlement, and final-order requirements before filing. Probate often creates several records over time. The first filing may be a petition or will. Later records can include the order appointing a fiduciary, bond, inventory, creditor notices, periodic or final settlements, and closing orders. Guardianship and conservatorship matters may have different proof and notice issues, so local clerk instructions matter even when the statewide jurisdiction rule is clear.

1. Decide whether the matter is routine probate, guardianship or conservatorship, or a contested adversary matter.

3. File the will, petition, fiduciary application, or related papers in District Court when appropriate.
4. Use Circuit Court for contested probate adversary proceedings under KRS 24A.120.

Mason County Probate Fees

Probate records may include a will, petition, order appointing a fiduciary, inventory, settlement or accounting, creditor notices, guardianship or conservatorship filings, and final orders. Not every estate record proves the same thing. A will shows stated intent. An appointment order shows who has authority to act. An inventory lists estate assets as reported to the court. A settlement or accounting shows how the fiduciary reports money, debts, and distributions. Recorded deeds and affidavits may show how estate property was transferred in county land records.

That office is separate from the Circuit Court Clerk, so probate researchers should match the record type to the right clerk.

Restricted Probate Records

Most estate files are public unless a statute, court rule, or order restricts access. Guardianship, conservatorship, mental-health, minor-related, adoption-adjacent, and sealed filings may be limited. For federal estate-related litigation or bankruptcy issues, local probate records are not the federal record source. Federal civil and bankruptcy searches use federal court systems.

If a public online search does not show a probate file, that does not always mean no record exists. The file may be older, indexed under a different party name, kept as a recorded county legal instrument, sealed in part, or available only through the clerk counter. The Office of Circuit Court Clerk and County Clerk should be treated as complementary search points, not duplicate offices.
